KSeF: When Does It Become Mandatory?

KSeF, or the National e-Invoicing System, is one of the biggest challenges facing businesses in the coming years. Although the system has been talked about since 2022, many companies are still unsure when exactly KSeF will become mandatory and what the consequences will be.

The answer? The mandatory KSeF will go into effect on July 1, 2026.

Why this date?

Initially, the mandatory KSeF was supposed to start in 2024. Then it was postponed to 2025. Finally, in February 2024, the Finance Ministry announced another postponement - this time to July 2026. The main reason was technical errors on the part of the system and concerns raised by businesses and software providers.

This is good news - companies have gained more time to prepare decently for the changes. But it's also the last such postponement, so there's no expectation of another one.

Who will be covered by the obligation?

As of July 1, 2026, every company registered as an active VAT taxpayer will have to issue invoices exclusively through KSeF. Whether you run a sole proprietorship, a large company or a foundation - if you issue VAT invoices, KSeF will apply to you.

A little later, the obligation may also extend to VAT-exempt companies and B2C transactions - but B2B is the first to be affected by the changes.

What does "mandatory KSeF" mean in practice?

After July 1, 2026, it will no longer be possible to issue invoices in PDF, send them by email, or print and physically transfer them. All invoices will have to be in structured format (XML) and sent directly to the KSeF system.

An invoice will only be considered issued when it is accepted by the KSeF system - not when it is generated.

Why prepare in advance?

Implementing KSeF is not just about updating your invoicing software. It's a change to your entire workflow - often requiring ERP integration, testing, electronic signatures and team training.

The earlier you start, the less risk that the system won't be ready on time. And delays can mean not only chaos in accounting, but also real penalties and problems with contractors.
